Extension of the Validity Period of Trademark Registration

The term of trademark validity is determined by legislation and lasts for 10 years with the possibility of unlimited renewal. This means that during this period, no one has the right to use your designation to mark their goods. An application for the extension of the trademark validity period must be submitted to Rospatent within the last year of the exclusive right. Failure to do so will result in the loss of your trademark, allowing anyone to register such a designation for themselves.

Please note that after registering a trademark, you must use it within three years from the date of registration. For example, you should label goods with it or display the mark on signage or in advertisements. Failure to use it may result in any individual requesting the sale of the exclusive right from you, and if you refuse, they may seek premature termination of the trademark through legal action, as stipulated in Article 1486 of the Civil Code of the Russian Federation.

It's important to remember that the ten-year term is calculated not from the date of issuance of the trademark certificate but from the date of application submission. Therefore, it's crucial to submit the application before the expiration of the term.

If you miss the deadline for renewing the registration of the trademark, don't despair, as you have six months to act. In addition to submitting an application, you need to file a motion for extension and pay an additional fee.
